What is the Model Tenancy Act (MTA)?

The Indian government developed the Model Tenancy Act to encourage the nation’s rental housing market. This policy aims to assist landlords and tenants by offering standards for the design of rental agreements.
When the states ratify the policy, it will supersede all current rental housing legislation in India.

Notably, the new law is progressive and will not apply retroactively to current rent agreements. Even once the rules are abolished, any existing rental agreement problems will still be handled under the previous legal framework.

Why are Rent Agreements For 11 Months Instead of a Full Year?

In India, signing a rental agreement for a property that is good for 11 months is customary. This is because registration and payment of stamp duty and other fees are necessary if the rental agreement is longer than this time frame. The tenant may find these fees to be pretty costly.
Furthermore, under the Model Tenancy Act (MTA), the landlord may be subject to additional legal obligations if the renting period is longer than eleven months. Therefore, it can benefit both parties to preserve the rental agreement for 11 months and renew it for extended periods to prevent potential issues and additional expenditures.
